Ezzy Express – Terms & Conditions

1. Definitions

• "Platform" refers to express.ezzyrun.ng and all associated services and applications.
• "User", "You" refers to any individual accessing or using the Platform.
• "Ezzy Express", "We", "Us", "Our" refers to Ezzy Run Technologies Ltd.
• "Products" means items available for purchase including groceries, farm produce, home essentials, and others.
• "Checkout Information" refers to personal details submitted by users when placing an order.

2. Acceptance of Terms

By accessing or using the Platform, you confirm that:

• You have read and understood these Terms.
• You agree to be legally bound by them.
• You consent to any additional guidelines or policies referenced within the Platform.

If you do not agree with these Terms, you should discontinue use of the Platform.

3. Eligibility & Access

• You may browse and place orders on Ezzy Express without creating an account.
• To complete a purchase, you must provide accurate personal details at checkout, including:

  • Delivery address
  • Phone number
  • Email address
• By placing an order, you confirm that you are at least 18 years old and legally capable of entering into contracts under Nigerian law.
• We may refuse service, cancel orders, or restrict access if the information provided is false, incomplete, or fraudulent.

4. Communications

By placing an order or using the Platform, you consent to receive:

• Order updates
• Delivery notifications
• Email receipts
• Service-related announcements

You may opt out of promotional messages at any time.

6. Service Fees & Pricing

• Browsing the Platform is free.
• Products are sold at the prices displayed at checkout.
• Delivery fees may apply depending on your location, time of day, or order size.
• Ezzy Express may change product prices or fees at any time.
• Any pricing changes will be clearly displayed before checkout.

7. Acceptable Use Policy

You agree not to:

• Violate Nigerian laws or regulations
• Provide misleading or fraudulent information
• Disrupt Platform operations or attempt unauthorized access
• Post harmful, defamatory, or illegal content
• Upload malicious software or harmful code
• Use bots, scrapers, or automated tools
• Abuse Ezzy Express staff or riders
• Engage in unauthorized advertising or promotions

Violations may result in account suspension or legal action.

8. Product Information & Availability

• We make every effort to ensure product descriptions, images, prices, and details are accurate.
• Minor variations may occur due to packaging changes, seasonal supply, or measurement differences.
• If a product differs significantly from its description, you may request a replacement or refund subject to our return policy.
• Product availability is dependent on stock levels and supplier availability.

9. Orders & Delivery

9.1 Order Confirmation

Once you place an order, you will receive confirmation that we have received it.

9.2 Delivery Notifications

You will receive updates when your order is processed, dispatched, and out for delivery.

9.3 Delivery Process

• Our riders will wait 10–15 minutes at your delivery location.
• If delivery fails due to your unavailability or incorrect details, a redelivery fee may apply.
• For safety, riders are not required to enter homes or private interiors. Delivery is completed at your door, gate, lobby, or designated point.

9.4 Inspection on Delivery

You should check your items within 10 minutes of receiving them to confirm accuracy and condition.

9.5 Third-Party Pickup

If someone else receives the order on your behalf, Ezzy Express is not responsible for issues arising afterward.

9.6 Order Modifications or Cancellations

• Orders cancelled before dispatch may be refunded in full.
• Orders cancelled after dispatch may attract a cancellation or delivery fee.
• Changing delivery time after dispatch may affect product freshness.

10. Payments

• All payments are made in Nigerian Naira (₦).
• Accepted payment methods include debit/credit cards, bank transfers, and supported digital wallets.
• Ezzy Express is not liable for payment failures caused by banks, network issues, or insufficient funds.
• Refunds will be issued using the payment method used at checkout unless otherwise stated.

11. Pricing Errors

If a product is mistakenly listed at the wrong price:

• Ezzy Express may cancel the order.
• You will be notified and refunded promptly if payment has been made.

12. Ownership of Content

• All content on the Platform—including images, text, logos, trademarks, code, and graphics—is owned or licensed by Ezzy Run Technologies Ltd.
• You may not copy, reproduce, distribute, or exploit Platform content without our written permission.

13. User-Generated Content

If you submit reviews, feedback, or photos:

• You grant Ezzy Express a non-exclusive, royalty-free, perpetual, worldwide license to use such content.
• You confirm the content is your original work and does not infringe any rights.

14. Privacy Policy

Your personal information is collected and used in accordance with our Privacy Policy and applicable Nigerian data protection laws. By using the Platform, you agree to how your data is handled.

15. Disclaimer of Warranties

Ezzy Express provides services "as is" and "as available."

We do not guarantee:

• Uninterrupted access
• Availability of all products
• Error-free Platform performance
• That the Platform is free from viruses or harmful components

You use the Platform at your own risk.

16. Limitation of Liability

To the maximum extent permitted by Nigerian law:

• Ezzy Express is not liable for indirect, incidental, or consequential damages.
• Our total liability for any claim related to a specific order shall not exceed the amount paid for that order.

17. Indemnification

You agree to indemnify Ezzy Express, its employees, agents, and affiliates against any claims or damages arising from:

• Your misuse of the Platform
• Your breach of these Terms
• Your violation of applicable laws

18. Termination

Ezzy Express may suspend or terminate your access if:

• You violate these Terms
• You engage in fraudulent activity
• Required by law enforcement or authorities

You may also discontinue use of the Platform at any time.

19. Governing Law

• These Terms are governed by the laws of the Federal Republic of Nigeria.
• Any disputes shall be resolved exclusively in the courts of Lagos State, Nigeria.
